T-1580-09_Abdelrazik_O_In Camera Motion (Sept 24 2024)

In this motion, CSIS asked to call several witnesses at a pending trial in Federal Court in a secret “in camera” hearing, due to a fear they might “inadvertently disclose” in their testimony information that Court had ruled in a CEA s. 38 application was protected by national security privilege.  Terms would have required a vetted transcript to be posted the next day after each hearing day.

The Court applied the Sherman test to hold this was not a justifiable limit on the open court principle.
