SCC reiterates importance of a fundamental principle in Canada: court openness, particularly through the media.
The Supreme Court of Canada issued an important judgment today in Canadian Broadcasting Corp. v. Named Person, 2024 SCC 21.
CMLA welcomes this judgment, which confirms that the idea of holding a secret trial in Canada is intolerable. The Supreme Court reiterates the importance of a fundamental principle in Canada: court openness, particularly through the media. It underscores that courts should be creative and flexible to minimize any impairment to the open court principle.
In addition, thanks to the efforts of the Canadian media who brought this issue forward, journalists, and therefore the public, will be able to access the judgment in this case which had been made inaccessible to them until now.
