Inquest Motion re broadcasting Provincial Court of Manitoba 2016 28 January

The applicants argued that s. 2(b) of the Charter protects the media’s right to record, videotape and broadcast the inquest proceedings, citing CBC v Canada [2011] 1 S.C.R. for the proposition.

The Attorneys General of Manitoba and Canada, and the Manitoba Association of Crown Attorneys argued that CBC v. Canada does not stand for the proposition that media has a constitutionally protected right to film and broadcast judicial proceedings. The judge in this instance, concurred with this view.
