Harris v LTM 2020 ABQB
The ABQB dismissed an application for an injunction brought by the plaintiff in a defamation action. The plaintiff is a police officer who applied to prevent the screening of an independent film about police brutality in Calgary, and also sought a mandatory injunction requiring the filmmaker to remove a promotional clip in which the officer appeared.
The officer alleged that the filmmaker had incorrectly subtitled the officer’s appearance in the film and promotional clip, which allegedly gave rise to a defamatory meaning. The court considered and applied the LibertyNet test, though the judge did not refer to the case name in his decision.
