La Presse, Le Devoir and Le Soleil publish articles by their journalists online. They have given exclusive rights to reproduce their publications electronically to Cedrom-SNi.

La Dose Pro offered its fee paying customers access to full titles and the first few lines of each article as published in the three newspapers.

La Presse, Le Devoir, Le Soleil and Cedrom-SNi applied for an injunction to prevent La Dose Pro from reproducing and posting articles from their respective websites.

The interlocutory injunction was granted after Justice Duprat found that La Dose Pro was infringing copyright and could not rely on fair dealing for the purpose of news reporting.
